Product Liability Basics

There are three different types of defects that can cause harm to consumers: design defects, manufacturing defects, and defects in marketing.

Products with design defects were defective before they were even made due to a flaw in the design. With manufacturing defects, something goes wrong during production or construction of the product.

Finally, defects in marketing can result in improper product instructions, products that do not live up to their warranties or a lack of necessary warnings regarding product use.

DePuy Hip Replacement Issues

DePuy Orthopaedics, a division of Johnson & Johnson, has announced a recall on the DePuy replacement system that reportedly has a high failure rate in many patients throughout the country. Lawsuits have been filed recently against the company for injuries sustained with the DePuy hip placement procedure. Both the DePuy ASR Hip Resurfacing System and the ASR XL Acetabular System have been recalled due to the problems that both systems have caused. Both systems consist of metal on metal hip implants that have resulted in severe pain and discomfort in many patients. After receiving the DePuy hip implant, many patients have complained of pain and discomfort on a daily basis, making even simple tasks a hardship.

Are you or a loved one suffering after receiving a DePuy hip placement? You may be entitled to compensation. Contact our product liability lawyers today!

Hip DePuy placement can cause various problems, including but not limited to:

  • Hip Pain
  • Loss of Mobility
  • Difficulty Standing or Walking
  • Hip Replacement Failure
  • Additional Hip Revision Surgery
  • Loosening of a DePuy Pinnacle Hip

According to a report released by DePuy, 1 in 8 patients who received the DePuy hip placement needed to have corrective surgery. One method of corrective surgery involves removal of the implant and then placing in a new device. However, many patients are experiencing an entire new set of challenges and pain from the corrective surgery as well. For some, these second surgeries have resulted in hip fractures, bone breakage, and hip dislocation.

Complaints about the DePuy hip implants originally started in 2005, but they were not recalled until just recently. Since the initial complaints, over 93,000 more patients have been subjected to receiving the DePuy hip placement. Many of these patients have since experienced various problems—problems that could have been prevented if the product was recalled back in 2005. DePuy has since admitted that the hip implants may result in something called Metallosis, a complication that results from metal parts rubbing together and causing parts to break apart. This can further complicate a corrective surgery by damaging soft tissue and putting the patient’s health at risk.

Did you Know?

Fail To Warn Drugs
When a pharmaceutical drug is produced, it is tested to make sure it does not cause severe side effects. The Food and Drug Administration (FDA) may still approve the drug as long as the dangerous side effects are rare.
